Open visiting policy in intensive care units is considered a favorable visiting regime that may benefit patients and their family members as well as medical staff. The article examines the conditions and causes of OVP-making process in Ukraine and presents the ethical analysis of its implications with respect to the key stakeholders: ICU patients, family members, and medical staff. The OVP, established by the Ministry of Health in June, 2016, changes current approaches to the recognition of the role of families (...) in critically ill patients’ care dramatically; it does, however, have serious shortcomings. The analysis of risks and benefits showed that OVP does not adequately cater to the needs of all the key players—family members, patients, and medical staff. Moreover, there is no clear mechanism to control OVP implementation via feedback from all the key players. These issues give rise to a concern that the implementation of OVP will die on the vine. In order to prevent this, a range of measures is required: the optimization of the ICU facilities and internal procedures, supervision of OVP implementation by policy-makers, training of medical staff, and providing family members with educational programs. Considering current shortcomings, it is crucially important to develop clear and consistent internal guidelines in hospitals that will guarantee the introduction of open ICU visiting and quality of critical care provisions. The phenomenon of religious experience is of interest to modern researchers in the field of phenomenology and analytical philosophy abroad, but remains unpopular in Ukraine. The interview talks about why philosophy does not stop trying to explore such experiences, and raises the question of the relevance of religion in the age of secularization. Jason Alvis clarifies some points of his project «phenomenology of inconspicuousness» and shares an unpopular view on the work of Martin Heidegger in general and on his concept (...) «eine phenomenologie des Unscheinbaren» in particular. The researcher draws attention to the difference in the reading and interpretation of Heidegger's philosophy in the USA and Europe. J. Alvis responds with his own concept to the challenge of the «spectacle era», which seeks to perceive God as another performance with special effects in the form of a miracle. But the most important thing is that the phenomenologist finally suggests moving away from obsessive dialectics, because God cannot be explained using the categories of «visible» or «invisible». So inconspicuousness does not mean that God cannot be seen. Just the opposite - it can and should be seen in completely everyday moments. Such a vision gives an active role to the subject of religious experience. The philosopher explains why the thesis that religion is irrelevant and unimportant today does not stand up to criticism and points out that in fact there is rather a turn towards religion. The good thesis «We make religion» reflects not only the modern view and possibilities of science in researching this issue. This is a call to fill religion with a new meaning, to finally notice in it a personality whose role could previously be leveled by tradition. In any society influenced by a plurality of cultures, there will be widespread, systematic differences about at least some important values, including moral values. Many of these differences look like deep disagreements, difficult to resolve objectively if that is possible at all. One common response to the suspicion that these disagreements are unsettleable has always been moral relativism. In the flurry of sympathetic treatments of this doctrine in the last two decades, attention has understandably focused on the simpler case in (...) which one fairly self-contained and culturally homogeneous society confronts, at least in thought, the values of another; but most have taken relativism to have implications within a single pluralistic society as well. I am not among the sympathizers. That is partly because I am more optimistic than many about how many moral disagreements can be settled, but I shall say little about that here. For, even on the assumption that many disputes are unsettleable, I continue to find relativism a theoretically puzzling reaction to the problem of moral disagreement, and a troubling one in practice, especially when the practice involves regular interaction among those who disagree. Moral Case Deliberations are reflective dialogues with a group of participants on their own moral dilemmas. Although MCD is successful as clinical ethics support, it also has limitations. 1. Lessons learned from individual MCDs are not shared in order to be used in other contexts 2. Moral learning stays limited to the participants of the MCD; 3. MCD requires quite some organisational effort, 4. MCD deals with one individual concrete case. It does not address other, similar cases. These limitations warrant (...) research into complementary ways of providing CES to healthcare professionals. Our research objective was therefore to develop a low threshold CES tool based on a series of MCDs on autonomy in long-term care. We used a qualitative research design in which we analyzed the process and content of a series of MCDs, combined with reflections on the theoretical background of MCD. In total 28 MCDs were analyzed by means of a thematic content analysis. In various rounds of development, the results of the analysis were combined with theoretical reflections on CES. Consequently, the tool was evaluated in three focus groups and adjusted. The CES tool, called ‘moral compass’, guides the users through a series of six subsequent questions in order to methodically reflect on their concrete moral dilemma, in the form of a booklet of 23 pages. It combines a methodical element that encourages and structures a reflection process with a substantive element, including norms, values, options, strategies, and insights regarding dealing with client autonomy. By using data from a series of MCDs, combined with theoretical reflections on MCD, ethics support and moral learning, we developed a thematic, low-threshold CES tool that supports healthcare professionals in daily practice in dealing with moral questions regarding client autonomy. It integrates examples and insights from earlier MCDs on the same topic. The moral compass is not a replacement of, but can be used complementary to MCD. The feasibility and impact of the moral compass need to be investigated in an evaluative follow-up study. The methodology presented in this paper may be used to develop moral compasses on different topics in various healthcare organizations. (shrink)

Disorders of Consciousness (DoCs) raise difficult and complex questions about the value of life for persons with impaired consciousness, the rights of persons unable to make medical decisions, and our social, medical, and ethical obligations to patients whose personhood has frequently been challenged and neglected. Recent neuroscientific discoveries have led to enhanced understanding of the heterogeneity of these disorders, and focused renewed attention on the medical and ethical problem of misdiagnosis. -/- This book examines the entanglement of epistemic and ethical (...) uncertainty in DoCs and other medical contexts, and how they interact to create both epistemic and ethical risks. Philosopher and bioethicist L. Syd M Johnson pulls together multiple threads in this work: the ontological mysteries of consciousness, medical uncertainty about unconsciousness, ableist bias, withdrawal of treatment in neurointensive care, and the rarely questioned view that consciousness is essential to personhood and moral status. Johnson challenges longstanding bioethical dogmas about DoC patients, and argues for an ethics of uncertainty for contexts where there is a need for decisive action in the presence of unavoidable uncertainty. The ethics of uncertainty refocuses ethical inquiry concerning persons with DoCs, placing less emphasis on their contested personhood, and more on inductive risk and uncertainty, on respect for autonomy, and especially on epistemic justice. With applications to various decisional contexts where uncertainty and ethical risk interact, this ethical approach enables surrogate decision makers facing fraught and risky choices to fulfill their obligations as moral and epistemic agents. The Emerging Issues Task Force (Kellmeyer et al. 2019) identifies several important trends and concerns that neuroethics will encounter and grapple with in the com- ing decades. Among these are ethical issues related to the creation of new nonhuman entities, such as artificial intelligence systems, and human origin entities like brain organoids. The task force briefly mentions animal minds and animal rights, to which neuroethics to date has paid scant attention (Buller et al. 2014). As neuroscientific knowledge and knowledge from (...) other fields, including, to name a few, comparative psychology, primatology, ethology, biology, genetics, and medical sociology, accu- mulate, ethical concerns about the use of nonhuman ani- mals in research, agriculture, entertainment, and elsewhere will grow more visible and more urgent. Turning neuroethical attention toward nonhuman ani- mals also promises to illuminate issues related to specific human populations that are within the purview of a more expansive, forward-looking neuroethics. A weak form of intuitionistic set theory WST lacking the axiom of extensionality is introduced. While WST is too weak to support the derivation of the law of excluded middle from the axiom of choice, we show that beefing up WST with moderate extensionality principles or quotient sets enables the derivation to go through.

The interconnections, common interests, and other linkages between the Jewish and Islamic traditions have long been a matter of interest to academics. Today the need to understand these relationships, and to emphasize commonalities rather than conflicts, is of the greatest public interest. The present volume of studies, likely the first such collection in the scholarly literature, explores the full range of interconnections between Jews and Muslims in all fields (intellectual history, religion, philosophy, social history, etc.) and in all periods, from (...) the Middle Ages till today. The essays have been written by some twenty distinguished scholars from North America, Europe, and Israel. The volume is dedicated to our esteemed colleague Joel L. We all seem to think that we do the acts we do because we consciously choose to do them. This commonsense view is thrown into dispute by Benjamin Libet's eyebrow-raising experiments, which seem to suggest that conscious will occurs not before but after the start of brain activity that produces physical action.

There is ongoing ethical and legal debate about withdrawing life sup- port for patients with disorders of consciousness (DOCs). Frequently fu- eling the debate are implicit assumptions about the value of life in a state of impaired consciousness, and persistent uncertainty about the quality of life (QoL) of these persons. Yet there are no validated methods for assessing QoL in this population, and a significant obstacle to doing so is their inability to communicate. Recent neuroscientific discoveries might circumvent that problem (...) and help shed light on QoL in DOCs. There is an ethical imperative to prioritize QoL research in this patient population, to provide evidence to inform treatment, research, and end of life decisions. A minimalist and pragmatic model of QoL is proposed, targeting positive and negative affect as domains for which there is po- tential to reach across the communication gap, and restore to these voiceless persons some measure of control. ABSTRACT‘Green’ concerns about nature, the environment or the climate have traditionally been juxtaposed with concerns about economic growth or job creation. Recently, however, a new type of conflict has appeared, in which different green concerns, for instance regarding mitigation of climate change and protection of landscape qualities, seem to collide. These environmental conflicts have so far received little scholarly attention. This article addresses the issue by a study of national and in particular local news media discussion on the construction of (...) wind turbines in Denmark, bringing together research traditions from environmental communication, discourse analysis, and place studies. Analytically, the study employs the notion of topos as the key meaning unit, referring to the premises upon which an argument is based. The phenomenon whereby severely disabled persons self-report a higher than expected level of subjective well-being is called the “disability paradox.” One explanation for the paradox among brain injury survivors is “response shift,” an adjustment of one’s values, expectations, and perspective in the aftermath of a life-altering, disabling injury. The high level of subjective well-being appears paradoxical when viewed from the perspective of the non-disabled, who presume that those with severe disabilities experience a quality of life so poor that it might (...) make their lives not worth living. This presumption has profound consequences, for it may inform end-of-life choices made in advance directives, or influence decisions made by surrogates on behalf of persons who are unable to direct their own medical treatment. -/- Peterson et al propose a cautious, well-considered plan to use fMRI-based brain-computer interfaces to assess the decision making capacity of covertly aware, behaviorally non-responsive individuals who retain high levels of preserved cognition. Their plan, if it succeeds, could eventually restore autonomy and empower some severely disabled persons, allowing them to participate in clinical decision making. Peterson et al discuss possible in-principle objections to their proposal, among them the “argument from psychological health,” and the “changing sets of values” objection. These objections both presume that deviations from a pre-injury norm could indicate diminished decision making capacity. This presumption threatens the autonomy of the patient who is capable of making decisions, but whose post-injury decisions appear to diverge from pre-injury preferences or values. In light of the potential for response shift, and the disability paradox, it should not be inferred that changes in values or preferences are unreflective of the true current preferences of a brain-injured person, nor are they conclusive evidence of diminished capacity. Presuming diminished capacity on the basis of unexpected or unconventional preferences has, in the past, been used to disempower patients whose autonomy and capacity would not have been doubted had they made choices that accorded with the expectations or values of others. We must be cautious, and vigilant, to prevent similarly diminishing the autonomy of covertly aware, behaviorally non-responsive individuals on the basis of empirically and ethically questionable inferences about their decision making capacity. The Hellenistic Schools of Epicureanism, Cynicism and Stoicism are considered to constitute the first, albeit modest, wave of feminism. But the question: ‘Were the Stoics Feminists?’ has attracted little attention due to a paucity of available evidence. What this paper attempts is a comprehensive treatment of the subject. In particular it addresses two distinct claims that have been made about the Stoic attitude to women. The first claim challenges the view that the Stoics were thoroughgoing feminists. The second is that, (...) given the Stoic fixation on social duty, women's relegation to the domestic sphere is a consistent Stoic position. It is argued that Stoicism was fundamentally committed to the emancipation of women even though many of its proponents were inconsistent feminists. This inconsistency put them at odds with Stoicism's avowed mission to provide a critique of social convention and to promote the ideals of the cosmopolis. (shrink)

In this paper, I analyse how neuroscientists come to the conclusion that the brain 'decides' what we will do. I do so by focusing on a recent study on free won't, from which it is concluded that the decision to veto is not free. First, I argue that assumptions about voluntariness and freedom that underlie this and other Libet-style experiments are more stringent than assumed by other critics. Second, I claim that these assumptions lead to an experimental setting in which (...) the conclusion that the brain 'decides' is almost unavoidable. This is because the only decisions subjects are allowed to make in these experiments are spontaneous decisions that are not based on reasons. Even if the subjects acted for reasons or deliberated about what to do it would not be interpreted as such. Because of this, alternative definitions of voluntariness and freedom are necessary for neuroscientific experiments to provide a valuable contribution to the debate on free will. (shrink)

The sphere of manifestation of philosophy is thinking. Thinking itself appears and is reflected in different forms, which contributes to a different perception of philosophy. The study and teaching of philosophy as a science is its main direction, an important condition for which is the disclosure of truth. Throughout history, this process manifested itself first as a manifestation of philosophy in theology, and then as its reflection in poetry. "Philosophy of Azerbaijani Studies" by Heydar Aliyev is a discourse aimed at (...) the formation and development of society. In other words, the national leader directed philosophy to its practical implementation in statehood and human life. According to our conclusions, Heydar Aliyev's "philosophy of Azerbaijani studies" was not only an intention, but also a means. The basis of this philosophy was laid in advance, but its full formation took place during the period of independence of Azerbaijan. The main tasks in this situation were self-consciousness, self-return and self-expression. The basis of the essence of the “philosophy of Azerbaijani studies” is, regardless of the affiliation and dissent of the people, to preserve and maintain the main traditions and cultural heritage. It is precisely such efforts that ensure the ideological security of society and actually prevent the creation of problems and barriers that block its development. Heydar Aliyev combined various understandings of globalization, multiculturalism and cosmopolitanism in a single understanding and reunited them in a common philosophy, which was called the “philosophy of Azerbaijani studies”. In his reports and speeches, explaining the essence of the "philosophy of Azerbaijani studies", he referred to a single whole of different cultures and noted the importance of solitude. The strategic plan and the main elements of the “philosophy of Azerbaijani studies” are the development of the Azerbaijani language, religion and culture, as well as the preservation of national and spiritual values and traditions. In the article, all these concepts are explained with illustrative examples. In integrity, Heydar Aliyev's "philosophy of Azerbaijani studies" serves to unite, preserve, develop the tradition of independence and create a legal-social state. (shrink)

The Philosophy of Time Society (PTS) grew out of a National Endowment for the Humanities Summer Seminar on the Philosophy of Time offered by George Schlesinger in 1991. The members of that seminar wanted to promote interest in the philosophy of time and Jon N. Turgerson offered to become the first Director of the PTS with the initial costs underwritten by the Drake University Center for the Humanities. Thus, the PTS was formed in 1993. Its goal is to promote the (...) study of the philosophy of time from a broad analytic perspective, and to provide a forum as an affiliated group with the American Philosophical Association (APA), to discuss the issues in and related to the philosophy of time. The society held its first meeting during the Eastern Division of the APA in Atlanta, GA, in December 1993. In 1997, L. Nathan Oaklander began his tenure as Executive Director of PTS and, with his term ending in 2000, he decided to put together a volume of selected papers read at PTS meetings over the years. The result is the present volume. It contains some of the latest developments in the field, including discussions of books by Michael Tooley (Time, Tense, and Causation), and D. H. Mellor (Real Time II), and much more. The main issue in the philosophy of time is and remains the status of temporal becoming and the passage of time. (shrink)

In a recent paper, Robert A. Oakes argues that a doctrine central to, and partially constitutive of, classical theism implies a certain sort of pantheism. The doctrine in question is a modal form of the claim that God conserves in existence the world of contingent things; alternatively, it is the view that all contingently existing things are necessarily continuously dependent upon God for their existence. The Oxford English Dictionary says that a rite is ‘a formal procedure or act in a religious or other solemn observance’. The word comes into English through the French rite from the Latin ritus . Its original meaning escapes etymologists; and this is a mixed blessing, for we neither can nor must attempt a retrieval of its hidden roots. We are told by respectable etymologists that the word is associated from earliest times with Latin religious usage, but that even in (...) the early Latin it was already extended to ‘custom, usage, manner or way’ of a non-religious sort. [Lewis and Short, A Latin Dictionary .] So, too, in modern languages the terms ‘rite’ and ‘ritual’ have specifically religious meaning, but they are also used in social and cultural settings that we would not call religious. What first strikes us about the terms ’ and ‘ritual’ is an emphasis upon a certain formality, upon a regular and stable way in which an action or set of actions is to be performed. A ritual is more than a formalism, however, since there are formalisms that are not rites, such as the logical rules for making a valid argument. Moreover, the term is frequently associated with the terms ‘myth’, ‘symbol’ and ‘faith’. These, too, are primarily religious, but are also extended to non-religious contexts. Indeed, there seems to be a network of such terms whose usage touches upon some extraordinary quality in things. Like them, the term ‘ritual’ shares both a wide variety of meanings and a certain hint of impropriety. The variety of ritual forms is notorious, ranging from the most sacred religious liturgies to the absurdities of a fraternity initiation; and the impropriety of the term breaks out whenever we brand a certain action ‘ritualistic’, just as we sometimes refer slightingly to an assertion, saying it is ‘mythical’, ‘merely symbolic’ or ‘credulous’. The period of the mid-1920s to the mid-1980s was a portentous period for Soviet psychology. As this period recedes into the past, the figure of L. S. Vygotskii rises more and more before us. Vygotskii died of tuberculosis when not quite 37 years old. He was a psychologist for only 10 years, and it was only in the last 6 of these that he did the work we now associate with his name. During those brief years Vygotskii wrote over 120 (...) works, including more than 10 large books. His was a short life — filled with inspired, indefatigable, and heroic work. A significant part of his written work has remained unpublished and indeed much of it remained unfinished. A seven-volume collection of Vygotskii's work is currently underway, and even this will not contain everything he wrote. The final volume of this collection will include his articles "The Sense of the Psychological Crisis" and "Spinoza's Theory of the Passions.". (shrink)

The question that I address in this paper is whether there is a right to privacy. It is not the question whether in the United States there is a legal right to privacy or, more particularly, a constitutional right to privacy. There are any number of ordinary legal rights and specific constitutional rights that might be so described, and the U.S. Supreme Court has referred also to a generic “right to privacy” that is implicit in the U.S. Constitution. Nor is (...) the question that I address whether persons have a moral claim to privacy that others ought to respect. I assume that in many circumstances, respecting a person's claim to privacy is productive of the good and, if so, that the claim ought to be respected. Rather, my question is whether persons have a right to privacy not dependent on positive law, such that it ought ordinarily to be respected without regard to the consequences, good or bad, simply because it is right. Defending the tenseless theory of time requires dealing adequately with the experience of temporal becoming. The issue centers on whether the defender of tenseless time can provide an adequate analysis of the presence of experience and the appropriateness of certain of our attitudes toward future and past events. By responding to a recent article, ‘Passage and the Presenee of Experience’, by H. Scott Hestevold, I shall attempt to show that adequate analysis of tenseless time is possible.

Gueroult was among the most influential French historians of philosophy in the twentieth century and the author of a long list of monographs on a host of modern philosophers. Gueroult's first book, on Maimon, was published in 1929, quickly followed in 1930 by a monograph on Fichte. Or, Heidegger nous invite, semble-t-il, bel et bien par là, à essayer de prolonger sa démarche et finalement à tenter de le comprendre mieux qu'il ne s'est compris lui-même. Ce bref essai, qui s'efforce de mettre en relation sa pensée, non seulement avec celle (...) de Kant, mais aussi avec celles de Bataille et de Lacan, afin que les unes soient éclairées par les autres, tente d'accomplir, précisément, cette démarche périlleuse qui consiste à essayer de comprendre la philosophie heideggérienne en dépassant sa lettre et en montrant qu'on peut ainsi parfois la "traduire" dans un autre langage que le sien (ce qui permettrait d'en finir avec le "jargon heideggérien").
